Cases Filed Against Dupont Alleging Water Contaminated with Chemical C8 /PFOA Caused Cancers

|

Fitzsimmons Law Firm recently filed four individual lawsuits against Dupont on behalf of the Firm’s clients who allegedly developed cancer as a result of consuming and drinking water that was contaminated with the chemical C-8 (also known as perfluorooctanoic acid (PFOA) or ammonium perfluorooctanoate (APFO), discharged from DuPont’s Washington Works Plant near Parkersburg, West Virginia.

Three of the plaintiffs developed kidney cancer and one developed testicular cancer. The Complaints were filed in the United States District Court of the Southern District of West Virginia.

The lawsuits allege that for years Dupont contaminated and polluted:

  • The drinking water
  • Groundwater
  • And air near and around its Washington Works plant with the chemical C8 (also known as perfluorooctanoic acid or PFOA)

Specifically, six water districts in West Virginia and Ohio were affected by DuPont’s toxic pollution:

  • Lubeck Public Service District (WV)
  • Mason County Public Service District (WV)
  • Little Hocking Water Association (OH)
  • City of Belpre Tuppers Plains – Chester Water District (OH)
  • And the Village of Pomeroy (OH)

In addition, it is believed that numerous private water wells and sources within these districts were contaminated. The lawsuits further allege that Dupont was aware that the C8 or PFOA was discharging into the atmosphere and water was at dangerously high and harmful levels yet failed to inform the public or governmental regulators.

In fact, Dupont disregarded this knowledge according to the Complaints and dumped C8 at increasing levels—by 2003 it was reported that DuPont had discharged approximately 2.5 million pounds of C8 in the Ohio River Valley.

What Is C8 / PFOA?

C8 or PFOA is a man-made chemical used in the process of making Teflon and other similar “non-stick” materials used in the manufacture of:

  • Fast-food wrappers
  • Waterproof clothing
  • Pizza boxes
  • Microwave popcorn bags
  • Carpet
  • Dental floss
  • And numerous other products

What Are the Dangers of C8 / PFOA Exposure?

As part of a previous class-action settlement involving DuPont and C8, an independent medical panel was established to determine whether there was a probable link between toxic exposure to the chemical C8 and various diseases.

After conducting years of research and studies, the panel concluded that at least 6 diseases were linked to C8 toxic exposure:

  • Kidney cancer
  • Testicular cancer
  • Pregnancy-induced hypertension (including preeclampsia)
  • Ulcerative colitis
  • Thyroid disease
  • And high cholesterol (hypercholesterolemia)
