$1 Million Recovered in Trucking Accident Wrongful Death Lawsuit
Fitzsimmons Law Firm PLLC recently obtained a $1 Million recovery for the family of a victim tragically killed in a trucking accident. According to the lawsuit, the collision was caused when the truck driver negligently and recklessly merged into the right hand lane without activating his turn signal or giving any other warning signs or signals that he was attempting to merge. Because of the truck driver's actions, the plaintiff's decedent was forced to accelerate his vehicle to avoid being struck by the tractor-trailer at which time the truck driver struck the tail of the plaintiff's decedent car causing it to spin into the opposite lane of traffic where it was struck by oncoming traffic. The plaintiff's decedent sustained severe and fatal injuries as a result of the collision.
The plaintiff asserted claims against the truck driver alleging that he was negligent and reckless in his operation of the commercial motor vehicle. The plaintiff also asserted a claim against the trucking company alleging that it failed to properly train its drivers how to safely and properly operate a commercial motor vehicle and on how to properly comply with Federal Motor Carrier Safety regulations. The truck driver and trucking company initially denied liability and alleged that the plaintiff's decedent was at fault for speeding. However, through the course of litigation, Fitzsimmons Law Firm was able to establish that the plaintiff's decedent was not negligent and that fault for the subject collision rested solely with the truck driver and trucking company. The $1 Million settlement represented the defendants' total available insurance limits.
