Natural Gas Home Explosion Leads to Wrongful Death Lawsuit

Fitzsimmons Law Firm recently filed a wrongful death lawsuit arising out of a residential natural gas explosion that tragically claimed the life of a thirteen year old girl. According to the Complaint, which was filed in the Circuit Court of Brooke County, West Virginia, the explosion occurred when the natural gas riser, plastic service line, meter, and/or regulator servicing the subject residence catastrophically failed thereby causing a natural gas leak at and/or near the subject residence. In their Complaint, the plaintiffs assert causes of action against the gas company alleging that it negligently and recklessly installed, serviced, maintained, monitored, inspected and/or tested the natural gas riser, plastic service line, meter, regulator and/or their component parts at the subject residence and/or negligently and recklessly failed to remove the natural gas riser, plastic service line, meter and/or regulator at the subject residence when said riser, service line, meter and/or regulator were defective and when the gas company knew or should have known said products were defective. The plaintiffs also brought product liability claims against the manufacturers of the gas riser and regulator alleging that these products were defective in that they were unreasonably dangerous and presented an increased risk of serious injury and/or death when used for their intended purpose.

In addition to the wrongful death claim, the Complaint also asserts claims for personal injury suffered by the family members who were inside and near the home at the time of the explosion. As a result of the explosion, one family member was blown through the roof and suffered severe burn and physical injuries as a result of the explosion.
