Widow Files Wrongful Death Suit Against Truck Driver and Trucking Company

Fitzsimmons Law Firm PLLC recently filed a wrongful death lawsuit against a trucking company and its driver when the driver allegedly caused a severe accident when he improperly swerved into the adjacent lane without signaling or warning other drivers on the road including the car being driven by the plaintiff's decedent.

According to the Complaint, the defendant truck driver recklessly and negligently swerved into the right hand lane without activating his turn signal or giving any other signs or signals to drivers in the right hand lane including plaintiff’s decedent. As the truck driver changed lanes, the truck struck the plaintiff’s decedent’s car causing it to spin into the opposite lane into oncoming traffic where it was struck at a high rate of speed by another vehicle. As a result of the collision, the plaintiff’s decedent suffered severe and fatal injuries.

The case is currently pending in the Circuit Court of Marshall County, West Virginia. The plaintiff is seeking all damages permitted by West Virginia law, including damages for medical bills, funeral expenses, and lost wages and benefits. The plaintiff is also seeking damages for pain and suffering suffered by her husband prior to his death as well as other wrongful death type damages, including sorrow, mental anguish, and loss of the decedent’s society, companionship, comfort, guidance, advice, services, protection, care and assistance.
