In 2004, Attorney Brent Wear joined the Fitzsimmons Law Firm PLLC. Since
then, he has focused his practice on helping clients in cases involving
personal injury and wrongful death, emphasizing helping victims of medical
malpractice, birth injuries, nursing home abuse, cases involving consumer
protection, premises liability, car accidents and more.
Born and raised in Wheeling, West Virginia, Brent attended Wheeling Central
Catholic High School and graduated in 1997. During his time at Wheeling
Central, he was a four year starter in football and was a two-time all-state
middle linebacker. He currently holds the school record for most tackles
in a career.
Following high school, Brent attended Allegheny College in Meadville, Pennsylvania
and graduated with honors in 2001. Upon graduating from Allegheny College,
Brent continued his pursuit of education at the West Virginia University
College of Law where he graduated with his Juris Doctor degree in 2004.
Since joining our legal team, Brent has successfully handled several multi-million
dollar settlements for those who have been negligently injured.
Brent has successfully tried medical malpractice and other injury claims
obtaining verdicts for his clients. In 2011, he was involved in a West
Virginia case that resulted in a jury verdict for the family of a 43-year-old
women. The 43-year-old woman went to a local ER to treat the chest pains
she was experiencing. She was discharged with a diagnosis that simply
consisted of "chest pain of unclear cause" and she died several
days later. Following closing argument presented by Brent, the jury returned
a substantial verdict in the plaintiff's favor finding that the doctor
had negligently failed to perform the necessary treatments for the patient
– including a proper cardiac work-up which, had it been properly
completed, would have prevented her untimely death. Beyond this case,
Brent has also been successful in obtaining settlements on behalf of clients
of car accidents, dog bites, insurance misconduct and fraud.
Another primary focus of Brent's practice is in helping clients who
have been wrongfully exposed to toxins. By successfully navigating mass
tort and toxic tort claims, he has been able to help the wrongfully injured
get the compensation they deserve. In fact, in one case he was recently
appointed by a court to serve as liaison counsel on behalf of hundreds
of plaintiffs in a suit against multiple corporate defendants.
Brent is proud to be admitted to practice not only in the states of West
Virginia and Ohio, but also in the United States Court of Appeals for
the Fourth Circuit and the United States District Courts for the Northern
and Southern Districts of West Virginia. He is also a member of the West
Virginia Bar Association and the Ohio County Bar Association where he
previously was a Treasurer.
When he is not practicing law, Brent enjoys co-hosting a weekly radio show,
"The Legislative Watchdogs," on
AM 1600 WKKX. During this show, he focuses on proposed legislation and legal issues
that could potentially affect consumers' rights, as well as issues
that affect workplace safety.
